TieCare — Terms of Service

These Terms of Service ("Terms") govern your use of the TieCare mobile application ("the App," "we," "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What TieCare is

TieCare is an informational and self-tracking tool that helps caregivers schedule and log post-frenectomy stretches, record healing photos, set reminders, and follow exercises. It is a convenience and organization tool only.

2. Not medical advice

TieCare does not provide medical advice, diagnosis, or treatment, and it is not a medical device. Using the App does not create a provider–patient relationship. Any information presented is general and educational and may not apply to your child. Always follow the specific instructions of your child's qualified healthcare provider (dentist, physician, IBCLC, or therapist). Never disregard or delay professional medical advice because of something in the App. In an emergency, call your local emergency number immediately.

3. Reminders are not guaranteed

The App's reminders and notifications depend on your device, operating system, and settings, and may be delayed, silenced, or fail to appear. You must not rely solely on the App to administer your child's care on time. You remain fully responsible for following your provider's aftercare schedule regardless of whether a notification appears.

4. Assumption of risk and your responsibility

You are solely responsible for all decisions regarding your child's care and for verifying any information before acting on it. You use the App at your own risk and accept full responsibility for outcomes related to your care decisions.

5. No warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, reliability, fitness for a particular purpose, or that the App or its reminders will be uninterrupted or error-free.

6. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or reliance on the App, including any health outcome, missed or delayed reminder, or loss of data. Our total liability for any claim relating to the App will not exceed the amount you paid for the App in the twelve months before the claim.

7. Indemnification

You agree to indemnify and hold us harmless from any claims or damages arising out of your use of the App or your violation of these Terms.

8. Purchases

In-app purchases are billed and fulfilled by Apple or Google and are subject to their terms. Refunds are handled by the applicable store under its policies.

9. Eligibility

You must be at least 18 years old and the parent or authorized caregiver of the child whose information you enter.

10. Intellectual property

The App and its content are owned by us and protected by applicable law. You receive a limited, non-transferable license to use the App for personal, non-commercial purposes.

11. Changes

We may modify the App or these Terms. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of [Your State/Country], without regard to conflict-of-law principles.
